1) Agreement to Terms
These Terms of Use (the “Terms”) are a legal agreement between Nordmeyer Cycling Mastery LLC, doing business as Nordmeyer Cycling Mastery (“Company,” “we,” “us,” or “our”), and you (“you” or “User”). By accessing or using the website, any content, or services provided through it (collectively, the “Services”), you agree to be bound by these Terms and our Privacy Policy.
If you do not agree, do not use the Services.
2) Eligibility & Accounts
You must be at least 18 years old or the age of majority in your jurisdiction. Minors may use Services only with the consent and supervision of a parent or legal guardian who accepts these Terms on the minor’s behalf.
You are responsible for safeguarding your account credentials and for all activities under your account.
3) Nature of Services; No Medical Advice
Our Services may include cycling coaching, training plans, fitness education, events, and related materials.
We do not provide medical care. Content is for educational purposes only and is not medical advice, diagnosis, or treatment.
Consult your physician before beginning any exercise program. Stop training and seek medical attention if you experience dizziness, fainting, pain, or shortness of breath.
4) Health & Safety; Assumption of Risk
Cycling and physical training involve inherent risks (e.g., falls, collisions, adverse weather, road hazards, traffic, cardiac events). By using the Services, you voluntarily assume all risks arising from participation, whether foreseeable or not.
You agree to:
Wear appropriate protective gear (including an approved helmet) and maintain your equipment in safe working order.
Obey all applicable laws, traffic rules, and event instructions.
Use good judgment and adapt your training to your abilities, health status, and conditions.
Waiver & Release. To the maximum extent permitted by law, you waive and release the Company, its instructors, contractors, and affiliates from any claims or liabilities arising from your participation in training or events, except to the extent caused by our willful misconduct or where prohibited by law.
5) Booking, Cancellations & No‑Show Policy
If the Services include sessions, events, or classes:
Scheduling. Book via our site or as instructed. You are responsible for ensuring you have the correct date/time (including time zone).
Cancellations/Rescheduling. You may cancel or reschedule no later than seven days before the start time. Late changes may be charged.
No‑Shows. Missed sessions may be forfeited and non‑refundable.
Weather & Safety. We may reschedule or modify outdoor sessions for safety. We will notify you as soon as reasonably possible
6) Fees, Payments & Refunds
Prices are shown at checkout or in your agreement. Taxes may apply.
Payments are processed by third‑party providers (e.g., Stripe, PayPal). We do not store full payment card details.
Except as required by law or stated otherwise in an order form, all sales are final. For subscriptions or packages, unused portions are non‑refundable unless required by law.
You agree not to make fraudulent chargebacks. We may suspend or terminate accounts for payment issues.
7) User Conduct & Community Standards
You agree not to:
Use the Services for unlawful purposes or to violate any laws.
Harass, threaten, defame, or infringe others’ rights.
Upload or transmit malware, spam, or content you do not have a right to share.
Interfere with or attempt to circumvent security or access controls.
Misrepresent your identity, credentials, or affiliations.
We may remove content and suspend or terminate access for violations.
8) User Content; Feedback
If you post or submit content (e.g., text, images, training data, testimonials) (“User Content”), you grant us a worldwide, non‑exclusive, royalty‑free license to host, display, reproduce, modify, and distribute that content to operate and promote the Services.
You represent you have all necessary rights to your User Content.
If you submit ideas or suggestions (“Feedback”), you grant us the right to use them without obligation or compensation.
9) Intellectual Property; Limited License
The Services, including all content, design, logos, and trademarks, are owned by the Company or its licensors and are protected by IP laws.
We grant you a limited, revocable, non‑transferable license to access and use the Services for personal, non‑commercial use.
You may not copy, modify, distribute, reverse engineer, or create derivative works except as expressly allowed by these Terms or by law.
10) Third‑Party Links & Services
The Services may link to third‑party websites, apps, or tools. We are not responsible for their content or practices. Your use of third‑party services is governed by their terms and policies.
11) Communications; E‑Signatures; SMS/Email Consent
By creating an account or providing contact information, you consent to receive service‑related communications (e.g., confirmations, updates). Where required, we will obtain your opt‑in for marketing communications; you can opt out at any time. Electronic signatures and records satisfy any legal requirement for written documents to the extent permitted by law.
12) Limitation of Liability
To the maximum extent permitted by law:
We will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business interruption.
13) Governing Law & Dispute Resolution
Governing Law. These Terms are governed by the laws of United States (USA) — Nashville, Tennessee 37205, without regard to conflicts of laws rules.
Venue. Courts located in United States (USA) — Nashville, Tennessee 37205 shall have exclusive jurisdiction, unless otherwise required by consumer protection laws.
14) Changes to the Services or Terms
We may update the Services and these Terms from time to time. Changes are effective when posted on the Site with a revised “Effective date.” Your continued use constitutes acceptance.
15) Termination
We may suspend or terminate your access at any time for any reason, including violation of these Terms. Upon termination, the license granted to you ends. Sections that by their nature should survive termination will survive.
